Q: A small child, one and a half years old, drank his aunt's milk that had been placed in a cup after she had expressed it from her breast with the intention of discarding it. Is it permissible for this child to marry the aunt's daughters?
A: The condition for breastfeeding that establishes prohibition is that it occurs within the first two years of the child's life, and that it consists of five breastfeedings or more. The definition of a breastfeeding is that the child holds the breast and sucks milk; when he releases it, either to rest or to move to another breast, it is counted as one breastfeeding, and so on until five breastfeedings are completed. If it falls short by even one breastfeeding, it does not establish prohibition; for Allah the Exalted said, in mentioning those who are prohibited:[An-Nisa 4:23] , and the Prophet (peace and blessings be upon him) said in the hadith agreed upon by al-Bukhari and Muslim: Sunan Ibn Majah 1937Sahih (Darussalam) And Muslim narrated from A'ishah (may Allah be pleased with her) that she said: Sahih Muslim 1452a . And whether he suckled from the breast or
drank it from a vessel in five sips, if he drank the milk in that manner, he is considered the son of his aunt through breastfeeding, and the brother of all her sons and daughters. If it falls short by even one, he is not considered her son. If there is doubt as to the number of breastfeedings, whether it is five or fewer, the original ruling is that there is no breastfeeding, so it does not establish prohibition. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
