Q: (E. M. S) wishes to marry the daughter of his wife’s paternal aunt, who is currently his wife, in terms of lineage, and the daughter he wants to marry is named (S. M. Th).
A: The criterion in this matter is that if there is a prohibited degree of kinship (mahram) between two women, it is forbidden to marry both of them, such that if one of them were a man, he would not be permitted to marry
the other. In the case asked about, this criterion does not apply, so it is permissible for (E. M. S) to marry the daughter of his wife’s paternal aunt, who is currently his wife; because the original ruling is the permissibility of combining them, and we do not know of any evidence preventing that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
