Q4: A woman had a misunderstanding with her husband, she took her rights and went to her father's house, and she conditions her husband by saying: I will not return to you until you buy me such and such, so is it obligatory for her husband to do this? And what is the opinion of the religion regarding this statement and what is similar to it?
A4: The legal principle of marriage is: good treatment between the spouses,
Allah the Exalted said:
And live with them in kindnessوَعَاشِرُوهُنَّ بِالْمَعْرُوفِ
And He the Exalted said:
And due to the wives is similar to what is expected of them, according to what is reasonableوَلَهُنَّ مِثْلُ الَّذِي عَلَيْهِنَّ بِالْمَعْرُوفِ
[Al-Baqarah 2:228]
It is not permissible for the wife to depart from the implications of the marriage contract regarding cohabitation and obedience except for a legal cause that permits her to do so. If she becomes defiant in her obedience to her husband without a legal cause and conditions that she will not return until he buys her such and such, then this is a form of harm from her toward her husband that is not permissible. It is obligatory for each of the spouses to exert excellence toward the other, and to work toward reconciliation and bringing the family together, and to cease the dispute. If reconciliation is not facilitated between them, then the recourse in that matter is to the court, and to what it deems sufficient, if Allah wills. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
