Q: My father passed away while I was in my mother’s womb. I have only one sister from him, who is older than me. When I was about fourteen years old and my sister was about twelve, my uncle came and wanted to marry my sister to his son, considering himself the closest relative. I was a child at the time and did not understand anything. He said: “I want to marry my son to your sister, and you have the choice when you reach maturity: either I marry you to one of my daughters, or I give you ten thousand as a mahr.” When I reached maturity, he gave me the choice between two things: either take the ten thousand, or he would give me one of his daughters in marriage. In fact, he gave me one of his daughters in marriage. Finally, I feared that there was a kind of exchange involved, since the mahr was not paid by me or by him. As for my sister’s rights, her husband completed them, such as clothes, jewelry, and other things. I have not been married yet; he only gave me one of his daughters in marriage. I ask your eminence to inform me whether this is connected to exchange (shigar). May Allah guide you to avoid falling into doubts, and may Allah reward you with the best reward for us.
A: If the matter is as you described, this is not a case of shigar (exchange of spouses); because there was no agreement between you and your uncle on an exchange, nor was it a condition. Rather, he promised you that he would marry you to his daughter or help you to marry someone else. Your uncle must pay your sister the mahr of the like if he has not already paid it to her, and you must
also pay the mahr of the like to your cousin. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
