Fatwa No. ( 2283 )
Q: My wife and I performed Hajj this year. After standing at 'Arafah , blood came from my wife (she was pregnant). It was not menstrual blood, and this blood did not stop; rather, it increased every day. It was later determined, after a medical examination, that she had suffered a miscarriage. Then, on the 15th of Dhul-Hijjah, a miscarriage and evacuation procedure was performed; this was due to the strain of the journey, as we traveled by car from Bisha to Makkah , and part of the road was unpaved and very poor. In any case, after the procedure, she was in a state of weakness and severe exhaustion due to the continuous bleeding before the operation. Then, since we were bound by work schedules, we returned to Bisha on Friday, the 17th of Dhul-Hijjah. She was, of course, unable to perform the Tawaf of Ifadah due to the continued bleeding and the uncertainty of when it would stop. Does she still owe the Tawaf of Ifadah, and is it obligatory for her to perform it whenever she is able so that her Hajj is completed? Or is the entire Hajj considered invalid, and must she repeat the Hajj in its entirety?
A: She must return and perform the Tawaf of Ifadah and Sa'y, if she was performing Tamattu' (combining 'Umrah and Hajj) or if she was not performing Tamattu' but did not perform Sa'y with the Tawaf of Arrival. By doing so, her Hajj is completed. She owes a sacrificial animal if her husband had intercourse with her after stoning the Jamarat al-Aqabah; it is to be slaughtered in Makkah whenever it is convenient, and it is obligatory to hasten in doing so, and it is to be distributed to the poor there.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
