The questioner : May Allah reward the honorableThe Shaykh : My father passed away ten years ago, and he had no debt, praise be to Allah, except for a house with installments owed to the real estate bank. This house was occupied by my eldest brother in exchange for him paying the bank installments every year. Recently, I saw my father in a dream in a specific state, asking me to look into a right owed to him.

The Shaykh : What is he asking for?

The questioner : He says: He is asking me to look into a right owed to him. After I inquired with the bank, it turned out that my brother had not paid three consecutive installments. When I asked him about it, he evaded the answer and accused me of not trusting him. My question, O honorable father: What is required of me in this situation? Is it obligatory for me to pay these installments if my brother refuses to pay? And on whom does the sin fall if the debt is not paid? I am an employee with a good salary, and I want to clear my father’s liability.

The Shaykh : Yes, I say: This is a blessing from Allah upon you and your father, that Allah enabled you to see him and alerted you to what is required of him. I say: If this debt is on the house that you inherited, you have no right to the house, not even a grain of dust, until you pay the debt on the house. I mean the debt that became due on your father before his death. If your brother refuses, then it is obligatory for you to pay from your share of this house the amount of your father’s debt corresponding to your share. For example, if the house is divided equally, you pay half of the debt on your father, and the rest is on your brother. But from this place, I advise my brother and say to him: O my brother, fear Allah regarding yourself and fear Allah regarding your father, and pay the debt, because you have no right to your father’s inheritance until the debt is paid. Yes.
Last question, because the time has ended.
