The Shaykh: And he headed the section with the following hadith, and its chain of narration is authentic. It was narrated from Abu Hurayrah that he said: The Prophet (peace and blessings be upon him) said to Abu al-Haytham, who is a man among the Companions named Abu al-Haytham ibn al-Tayhan, that he said to him (peace be upon him) while asking him to know his need and what is lacking in his life. So he said to him (peace be upon him):
"Do you have a servant?" "No," he replied. He said, "Come to us when we get some captives." The Prophet, may Allah bless him and grant him peace, was brought only two captives. Abu'l-Haytham came to him and the Prophet, may Allah bless him and grant him peace, said, "Choose between them." "Choose for me, Messenger of Allah," he replied. The Prophet, may Allah bless him and grant him peace, said, "The person who is consulted is in a position of trust. Take this one. I have seen him pray. Treat him well." Abu'l-Haytham's wife said, "You will not live up to the words of the Prophet, may Allah bless him and grant him peace, about him until you set him free." "He is free," he stated. The Prophet, may Allah bless him and grant him peace, said, "Allah did not send a Prophet or khalifa but that he has two confidants: a confidant who commands him to do what is correct and forbids what is bad, and a confidant who will not fall short in corrupting you. Anyone who is protected from the evil confidant has been protected." هل لك من خادم قال : لا ، قال : فإذا أتانا سبي فأتنا ، فأتي النبي - صلى الله عليه وسلم - برأسين ليس معهما ثالث فأتاه أبو الهيثم ، قال النبي - صلى الله عليه وآله وسلم - : اختر منهما قال : يا رسول الله اختر لي ، فقال النبي - صلى الله عليه وآله وسلم - : إن المستشار مؤتمن ، خذ هذا فإني رأيته يصلي واستوص به خيرًا ، فقالت امرأته : ما أنت ببالغ ما قال فيه النبي - صلى الله عليه وآله وسلم - إلا أن تعتقه ، قال : فهو عتيق ، فقال النبي - صلى الله عليه وآله وسلم - : إن الله لم يبعث نبيا ولا خليفة إلا وله بطانتان : بطانة تأمره بالمعروف وتنهاه عن المنكر ، وبطانة لا تألوه خبالا ، ومن يوق بطانة السوء فقد وقي

. This hadith contains many benefits, and the point of interest in it is his saying (peace be upon him):
The one who is consulted is trusted إن المستشار مؤتمن
. So let us return to the beginning of the hadith to comment on it with what is appropriate for the occasion. The Prophet (peace and blessings be upon him) said to Abu al-Haytham:
"Do you have a servant?" "No," he replied. He said, "Come to us when we get some captives." هل لك خادم قال : لا ، قال : فإذا أتانا سبي فاتنا

. Captives are prisoners of men and women, and we have mentioned more than once that these prisoners who fall into the hands of the Muslim army, the commander of the army has the authority to deal with them in one of four ways: either he releases them and frees them and grants them a favor, or he ransoms them with Muslim prisoners who have fallen into the hands of the disbelievers, exchanging prisoners as is said in the present age, or he enslaves them and makes them slaves by presenting these prisoners to the Muslim army, or finally he kills the prisoners if he sees that it is in the interest of the Muslims. This last category occurred in the history of the Messenger (peace be upon him) and his biography regarding some individuals, until he said:
Kill Ibn al-Akhtal, even if you find him clinging to the curtains of the Ka'bah اقتلوا ابن الأخطل ولو وجدتموه متعلقًا بأستار الكعبة
. The most common of the four matters is either ransom or enslavement. So when the Messenger (peace and blessings be upon him) asked Abu al-Tayhan, "Do you have a servant?" and he said, "No," he said to him (peace be upon him):
If captives come to us فإذا جاءنا سبي
, meaning, we have made a decision regarding the enslavement of the prisoners, so come to us. So the prisoners came to the Prophet (peace and blessings be upon him), and as the Messenger requested of Abu al-Tayhan to come to him, he came. There was not among the captives in the presence of the Messenger (peace be upon him) anyone suitable to be a servant except two persons, meaning two individuals. So the Messenger (peace be upon him) presented them to Abu al-Tayhan and said to him, "Choose whichever you wish." So Abu al-Taytham returned to the Prophet (peace and blessings be upon him) seeking his advice and saying to him, "Choose for me, you know better than I." So he said to him (peace and blessings be upon him):
The person who is consulted is in a position of trust. Take this one إن المستشار مؤتمن خذ هذا
Al-Adab Al-Mufrad 256
, meaning, since you have entrusted the matter to me to choose one of them for you and make him suitable for serving you, I advise you to take this one, so take him.
The one who is consulted is trusted إن المستشار مؤتمن
Since you have consulted me, I must fulfill the trust and advise you, so I advise you to take this one. Why did the Messenger (peace be upon him) advise him with him? He said:
For I saw him praying فإني رأيته يصلي
.
