The Shaykh : May Allah guide you and set your affairs right. Yes.

The questioner : He says: A man performed the lesser pilgrimage and forgot to shorten his hair or shave it, and he put on his clothes, then he remembered while he was in Makkah that he had not shortened or shaved his hair, and he traveled to his country. Question: What is the ruling on his lesser pilgrimage, and what should he do?

The Shaykh : His lesser pilgrimage is valid, because all that remained for him was shaving or shortening the hair. However, some scholars say: he should shave or shorten the hair, meaning: he should take off his clothes now, because it is forbidden for him to wear clothes before shaving or shortening the hair, so he takes off the clothes, puts on the clothes of ihram, then shortens or shaves the hair. And some of them said: the blood is established upon him for leaving Makkah, and he slaughters in Makkah a fidyah (ransom payment) to be distributed to the poor. I think the latter is better, that he slaughters a fidyah in Makkah to be distributed to the poor, if he is wealthy. As for if he is poor, he owes nothing. Yes.
