The questioner : A man performed Hajj last year and delayed the tawaf of ifadhah along with the tawaf of farewell. He says: I performed the tawaf of ifadhah, but I was not in a state of wudu. I also performed the Isha and Maghrib prayers, and I was not in a state of wudu. Please advise us on this?

The Shaykh : We inform you that your Maghrib and Isha prayers performed without wudu are invalid. You are sinful for this if you knew that this is forbidden, and you must repeat them now. You should pray Maghrib three times and Isha four times, because you prayed behind the imam, and a traveler who prays behind the imam must complete the prayer. As for the tawaf, the stronger position in my view is that you are not required to repeat it, because there is no evidence that ritual purity from minor ritual impurity is obligatory in tawaf. This is what the Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) chose, and he argued for it and supported it with proofs. One who reviews them knows that this opinion is the correct one. However, a person should not be lax in this matter and perform tawaf without wudu. Rather, if a situation like the one the questioner asked about occurs, he is not required to repeat the tawaf, and his Hajj is complete.
