The questioner : A man who owes blood money and collected funds for it pursuant to a ruling given to him by the court, but after completing the required amount, continued collecting to keep it for himself and benefit from it in his life without informing the people that he had completed collecting this blood money. Is this money considered lawful or not? May Allah reward you with good?
The Shaykh : Anything in excess of the blood money is forbidden for him. He must stop once the required amount for the blood money is reached, because he is soliciting people based on this document, and the document only contains the debt of the blood money. Therefore, it is not permissible for him to continue collecting money after obtaining what he asked of people for its sake. Similarly, some people collect funds to build a mosque and gather amounts in excess of what the mosque needs, yet they continue collecting for the mosque even though the mosque has already obtained what it needs. This is also forbidden and not permissible for him. For this reason, we say that if someone submits a petition to people to build a mosque and collects an amount of money that exceeds the sufficiency of the construction, it is obligatory for him to stop. However, he might say: "I fear that circumstances will change. I fear that I will collect for this mosque what I think is sufficient for its construction, but it will not be sufficient due to changing circumstances, such as an increase in prices or an increase in contractors' fees, or the like." We say: There is no harm if you collect what you think is sufficient and then stop. After that, record the name of every person who donates to you, so that when the construction is completed and you find an excess, you will know that the excess belongs to so-and-so, so-and-so, and so-and-so. This will make it easy for you to give it to them or seek their permission to spend it on the mosque's interests other than the construction, or on building another mosque.
