The Shaykh : He owes nothing. That is to say, touching the penis does not invalidate the wudu. However, if it is done for the sake of sexual desire, it invalidates the wudu. This distinction reconciles the evidence, for the Prophet (peace and blessings be upon him) was asked about a man who touches his penis during prayer and whether he needs to perform wudu, and he said:
No, it is only a part of your body لا، إنما هو بَضعة منك
Bulugh al-Maram 72
Touching a part of one’s own body is not considered a nullifier of wudu; it is like touching one’s leg with one’s hand, in which case the wudu is not invalidated.
The other hadith is the hadith of Busrah bint Safwan, in which the Prophet (peace and blessings be upon him and his family) said:
He who touches his penis should perform ablution. من مس ذكره فليتوضأ
Sunan Abi Dawud 181Sahih (Al-Albani)
This indicates the obligation of wudu from touching the penis. The reconciliation between this and the first hadith is that if a person touches it for the sake of sexual desire, it differs from touching the other limbs, and his wudu is invalidated.
