The Meaning of the Saying of Allah the Exalted: “... and fear Allah your Lord. Do not drive them out of their homes, nor should they go out, except in the case of open immorality. And these are the limits of Allah...”

Machine translationRead the Arabic original
The Shaykh :
and fear Allah, your Lord. Do not turn them out of their [husbands'] houses, nor should they [themselves] leave [during that period] unless they are committing a clear immorality
[At-Talaq 65:1]
“Do not drive them out of their homes.” To whom does the pronoun refer? It refers to divorced women. When a man divorces his wife, it is obligatory for him to keep her in the house, and it is not permissible for him to drive her out of it. Do people today act in accordance with this, or contrary to it? They act contrary to it. When he divorces her, he expels her, and this is forbidden and a disobedience to Allah (Mighty and Majestic). Rather, it is obligatory that she remain in the house.
Do not turn them out of their [husbands'] houses
[At-Talaq 65:1]
For this reason, He attributed the homes to the women; He attributed the homes to the women as if her remaining in the house is a right for her, because it is her house. So how can he drive her out of it? If he drives her out of it, he is unjust to her, because the house is her house. If he drives her out of it, he is disobedient to Allah, because Allah said what?
Do not turn them out of their [husbands'] houses
[At-Talaq 65:1]

Now, if she wants to go out, as is the custom of some women when their husband divorces them, they get angry and leave on their own. We say: Do not go out; it is forbidden for her to go out.
and let them not go out ولا يخرجن
Until when? Until the end of the waiting period.
unless they commit a clear immorality
[An-Nisa 4:19]
So there is no harm in the husband driving her out. The “open immorality” was explained by many scholars as being foul-tongued, foul-tongued, and harmful to him and his family. In this case, he is excused if he drives her out of the house. Otherwise, it is forbidden for him to drive her out. Then he said:
And those are the limits [set by] Allah. And whoever transgresses the limits of Allah has certainly wronged himself. You know not; perhaps Allah will bring about after that a [different] matter.
[At-Talaq 65:1]
This is the reason for the prohibition of driving them out and of their going out.
You know not; perhaps Allah will bring about after that a [different] matter.
[At-Talaq 65:1]
So what is the matter? The matter is that he should take her back. If she remains in the house and his opinion changes, and hearts are in the hand of Allah (Mighty and Majestic), He may turn hatred into love and love into hatred, he will take her back in the house, and it will be as if nothing happened. For this reason, he said:
You know not; perhaps Allah will bring about after that a [different] matter.
[At-Talaq 65:1]
And with this reason, we know that if the divorce was the third of three divorces, meaning the third pronouncement, then he has the right to drive her out. Why?
The student: ... .

The Shaykh : Because no new situation will occur after that, because there is no taking back; so she is divorced from him with a major final divorce.
