The questioner : Praise be to Allah. These are questions regarding Hajj. A pilgrim was in a state of major ritual impurity on the night of 'Arafah and continued his Hajj until he finished and returned to his country. What is required of him?
The Shaykh : Praise be to Allah, and may Allah send blessings and peace upon the Messenger of Allah. This is a great and major sin, for he spent all these days praying without ritual purity. The Prophet (peace and blessings be upon him) said:Sunan Ibn Majah 274Sahih (Darussalam) Therefore, it is obligatory for him to repeat all the prayers he performed before taking a full ritual bath. As for the Hajj, he must repeat the tawaf of Ifadah because he performed tawaf while in a state of major ritual impurity. Tawaf is not valid for a person who is in a state of major ritual impurity, because one in such a state is prohibited from staying in the mosque, as Allah the Exalted said: [An-Nisa 4:43].
If he is married, he must avoid his wife until he returns to Makkah and performs the tawaf of Ifadah. In this case, he should enter the state of ihram for 'Umrah from the miqat, then perform tawaf, sa'y, and shorten his hair. After that, he should perform the tawaf of Ifadah. In addition to all of this, he must repent to Allah by feeling remorse for what happened, recognizing that he was negligent and careless in the right of Allah, and resolving not to return to such an act.
The questioner : May Allah reward you with good.
