The questioner : A man wants to take a trip to the western region and wants to stay in Jeddah for several days, and he loves to perform 'Umrah. Another man came from outside the Kingdom, and his route passes through Jeddah, and he loves to perform 'Umrah. Do they perform 'Umrah from Jeddah, or are they required to enter the state of ihram from the miqat? May Allah reward you with good.

The Shaykh : The criterion in this matter is the intention. The Messenger (peace and blessings be upon him) designated the miqats and said:
and those (Mawaqit) are also meant for those who live at these (places) and for those too who come from without towards them for the sake of Hajj or 'Umra هن لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة
Sahih Muslim 1181a
meaning: for those who are not residents of the lands for which they were designated
with the intention of (performing) Hajj and Umra ممن أراد الحج والعمرة

. So whoever intends Hajj or 'Umrah, he must enter the state of ihram when he reaches the level of the miqat, and then he fulfills the purpose he intended. But if a man’s home is in Jeddah, for example, and he traveled from his city to Jeddah to see his family, but in his intention he plans to perform 'Umrah on one of the days, then he is not required to enter the state of ihram, because his trip is, in reality, a trip to his family.
As for the one who intends to go to Makkah but says, "I will first attend to my business, then I will enter the state of ihram from the place where I finished my business," that is not permissible for him. He must return to the miqat he passed and enter the state of ihram from there.
This is regarding the one who traveled from a city within the Kingdom to the western region for business. As for the one coming from Egypt to the Kingdom, we also ask him about his intention. If he intends to arrive for the work he does in the Kingdom, but in his intention he plans to perform 'Umrah on one of the days, then he is not required to enter the state of ihram. But if his intention in this trip is to perform 'Umrah and to go to his work, then he must enter the state of ihram.
