The author said, “from what is forbidden”, and this is a comprehensive term that includes guarding the private parts from unlawful sexual intercourse, guarding the private parts from looking, and guarding the private parts from the forbidden act that is less than unlawful sexual intercourse. Allah Mighty and Majestic has specified who guards their private parts from Him and who does not, so He the Exalted said: [Al-Mu’minun 6:7]. The highest thing from which the private parts must be guarded is unlawful sexual intercourse, which is committing the obscene act in the front or the back. However, when it involves the male organ, it is called sodomy, and sodomy is greater than unlawful sexual intercourse, may Allah protect us from it, because the punishment for sodomy is execution in all cases. In fact, the most correct view is that the punishment is killing in all cases, whether the perpetrator is married or unmarried, provided that he is of legal age, meaning an adult and of sound mind. If a man commits sodomy with another man, and both are of sound mind and adults, they must be killed, even if they are not married. But how are they killed? The Companions (may Allah be pleased with them) and those after them differed on this. It was said that they are stoned to death with stones, like the married adulterer. It was said that they are thrown from the highest place in the city and then stoned. It was said that they are burned with fire, as Abu Bakr (may Allah be pleased with him) did when he wrote to Khalid ibn al-Walid after Khalid told him that he had a man who has intercourse as a woman does. Abu Bakr wrote to him to burn him, exaggerating in the punishment. So the most obligatory thing is to guard the private parts from unlawful sexual intercourse. Likewise, looking must be guarded; a person must guard his private parts from looking, even of the same sex. For this reason, the Prophet (peace and blessings be upon him) said: Sunan Ibn Majah 661Sahih (Darussalam) So the private parts must be guarded from looking, except for the wife and what one’s right hand possesses. Likewise, guarding the private parts from forbidden acts other than unlawful sexual intercourse, sodomy, and looking, such as masturbation, for example, which is known among people as the secret habit. It occurs in men and also in women, even women practice it. This is also forbidden and not permissible, because it does not involve guarding the private parts. Indeed, the person who seeks to satisfy his desire other than with his wife and what his right hand possesses falls under the saying of Allah the Exalted: So it is forbidden by the Qur’an and by the Sunnah as well.
