Explanation of the words of Imam al-Nawawi (may Allah have mercy on him) regarding what he quoted: "

Machine translationRead the Arabic original
The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful:
The author (may Allah have mercy on him) said in: “The Chapter on the Right of the Husband over His Wife”: He said, as he quoted from Abu Hurayrah (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said:
When a man calls his wife to come to his bed (for marital relations), and she refuses to come, and he spends the night in anger, the angels curse her till the morning.
Bulugh al-Maram 8:66
.
The cursing of the angels means: that they invoke the curse upon this woman. And the curse is: “being cast out and kept away from the mercy of Allah”. So if he calls her to his bed to enjoy her in what Allah has permitted him, and she refuses to come, then the angels curse her, may Allah protect us from that; they invoke the curse upon her until morning.
The second wording is:
That if she neglects her husband’s bed, then Allah the Exalted becomes angry with her until the husband is satisfied with her
: And this is more severe than the first, because if Allah (Glorified and Exalted is He) becomes angry, then His anger is greater than His curse. We ask Allah for safety. And the evidence for that is that Allah the Exalted mentioned in the verse of li'an, when the man takes the oath, he says:
that the curse of Allah be upon him if he should be among the liars.
[An-Nur 24:7]
, and when she takes the oath, she says:
that the wrath of Allah be upon her if he was of the truthful.
[An-Nur 24:9]
. And this indicates that anger is more severe, and it is so.
Also, he said in the hadith:
the One Who is in the heaven is displeased with her until he (her husband) is pleased with her.
Sahih Muslim 1436c
: meaning the husband. And there he said:
Until morning
. But here he tied it to the husband’s satisfaction. And this may be less, and it may be more. That is, perhaps the husband is satisfied with her before the dawn breaks, and perhaps he is not satisfied except after a day or two. The important thing is that as long as the husband is angry with her, Allah (Mighty and Majestic) is angry with her.
And in this is evidence for the greatness of the husband’s right over his wife. But this is in the case of a husband who fulfills the wife’s right. As for if he is defiant and does not fulfill her right, then she has the right to take retribution from him and not to give him his full right, by the saying of Allah the Exalted:
So whoever has assaulted you, then assault him in the same way that he has assaulted you
[Al-Baqarah 2:194]
, and by His saying the Exalted:
And if you punish [an enemy, O believers], punish with an equivalent of that with which you were harmed
[An-Nahl 16:126]
: But if the husband is upright and fulfilling her right, and she is defiant and withholds her right from him, then this is her recompense if he calls her to his bed and she refuses to come.
And the conclusion is that these wordings that came in this hadith are absolute, but they are restricted by what I mentioned to you. By what?
By his fulfilling her right. As for if he does not fulfill her right, then she has the right to take retribution from him and to withhold his right from him, just as he withheld her right from her, by the two verses that I mentioned:
So whoever has assaulted you, then assault him in the same way that he has assaulted you
[Al-Baqarah 2:194]
,
And if you punish [an enemy, O believers], punish with an equivalent of that with which you were harmed
[An-Nahl 16:126]
.
And in this hadith is clear evidence for what the people of the Sunnah and the community and the Salaf of the Ummah held, namely that Allah (Mighty and Majestic) is in the heaven. He Himself (Exalted and Majestic is He) is above His Throne, above the seven heavens. And what is not meant by His saying:
In the sky
: is that His kingdom is in the heaven. Rather, this is a distortion of the words from their places. And distorting the words from their places is the doing of the Jews, may Allah protect us from that, who distorted the Torah from its places: from what Allah intended by it. For the kingdom of Allah (Glorified and Exalted is He) is in the heaven and in the earth:
And to Allah belongs the dominion of the heavens and the earth
,
Say, "In whose hand is the realm of all things - and He protects while none can protect against Him قُلْ مَنْ بِيَدِهِ مَلَكُوتُ كُلِّ شَيْءٍ وَهُوَ يُجِيرُ وَلا يُجَارُ عَلَيْه
[Al-Mu'minun 23:88]
,
And to Allah belong the reins of the heavens and the earth
. All the heavens and the earth are in the hand of Allah (Mighty and Majestic). All of it is the kingdom of Allah.
