Question:
What is the ruling on one who performed 'Umrah and forgot to shorten his hair, and did not remember until after he had returned to his place of residence in the city from which he had departed and traveled?

Answer:
If one forgets to shorten his hair during Hajj or 'Umrah, and does not remember until he is on the road, or in his home, he should shorten his hair with the intention of 'Umrah or Hajj. He should shorten it, and if he is in the state of ihram, he should remove his ihram garments. If it is 'Umrah, he removes the garments and remains in the lower garment, then he shortens or shaves his head so that his 'Umrah is completed. If he shortens his hair while still wearing his ihram garments due to ignorance or forgetfulness, he owes nothing, even if he is in his home.
The same applies to Hajj: if he remembers in his home, or on the road, he shortens or shaves his hair, and his Hajj is complete. In Hajj, it is possible to exit the state of ihram by stoning the pillars and circumambulation, so he would have exited the state of ihram. However, if he has intercourse with his wife before shortening his hair, he owes an expiation—a sacrificial animal slaughtered in Makkah for the poor—if it is Hajj. As for 'Umrah, the matter is easier: he gives charity of three sa' (a dry measure of about 3 kg) to six poor people, or fasts for three days, or slaughters a sheep if he has intercourse with his wife after the circumambulation and walking between al-Safa and al-Marwah, before shortening his hair, before shaving his head. This is if he did it intentionally.
As for if he was forgetful, he owes nothing:
Our Lord, do not impose blame upon us if we have forgotten or erred.رَبَّنَا لَا تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا
[al-Baqarah:286], as in the hadith:
If anyone forgets that he is fasting and eats or drinks he should complete his fast, for it is only Allah Who has fed him and given him drink.من نسي وهو صائم فأكل أو شرب فليتم صومه، فإنما أطعمه الله وسقاه

, but if he was not forgetful but did it out of ignorance, he shortens his hair, and praise be to Allah, and he owes nothing.
