Question:
He has another question that does not concern fasting. He says: We found a dead man hanging from a tree, with a rope around his neck, and we do not know whether he killed himself by strangulation or whether someone hanged him after killing him. If it was he who hanged himself with the rope on the tree in order to die, do the Muslims pray over him or not?
Answer:
If he was a Muslim, then he is prayed over, whether he killed himself or someone else killed him; he is prayed over. And if he committed a great crime—if he killed himself by strangulation, he has committed a great crime—because a Muslim has no right to kill himself. Allah (Exalted and Majestic is He) has forbidden people to kill themselves. He, the Exalted, said: [Al-Nisa: 29] And the Prophet (peace and blessings be upon him) said: Sunan Abi Dawud 3257Sahih (Al-Albani) But if it is known that he killed himself, then he has erred and committed a crime.
As for the prayer, he is prayed over; because sin does not prevent one from praying over him. Some of the Muslims pray over him, and they wash him. They wash him first and shroud him, then they pray over him, and then he is buried in the Muslim cemeteries.
And likewise, if it is known that he was murdered, that someone else killed him unjustly, then he is washed and prayed over. He is washed and shrouded, and prayed over, and buried in the Muslim cemeteries. And Allah is the Helper. There is no power and no strength except with Allah. Yes.
