Question:
This questioner is Sudanese and resides in the Northern Region. He says, “Your Eminence: We are in the Northern Region, and we have severe cold in the winter to the point that the water sometimes freezes. Is it permissible for me to perform tayammum, even though I have done so for three months? Do I have a sin for that?”

Answer:
You are not permitted to perform tayammum while you are able to use hot water. Tayammum is for the one who is unable to use hot water during the cold, as ‘Amr ibn al-‘As did in some of the battles when the cold became severe and he feared for his life, he performed tayammum. As for the one who can use hot water, he is not permitted to perform tayammum; he should heat the water and perform wudu’, and wash himself if he is in a place where he can protect himself from the cold, such as a tent or a house or the like. As for the one who is unable and has nothing to heat the water with, there is no harm in his performing tayammum if he fears for his life. Allah, Exalted and Majestic is He, says:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[al-Taghabun: 16], and He says, Exalted is He:
Allah does not charge a soul except [with that within] its capacityلا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا وُسْعَهَا
[al-Baqarah: 286], and He says, Exalted is He:
while He has explained in detail to you what He has forbidden you, excepting that to which you are compelledوَقَدْ فَصَّلَ لَكُمْ مَا حَرَّمَ عَلَيْكُمْ إِلَّا مَا اضْطُرِرْتُمْ إِلَيْهِ
[al-An’am: 119]. Yes.
And you must make up the prayers, you must make up these prayers that you left. Yes.
