Praise be to Allah alone, and may peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the questioner: the Chairman of the Board of Directors of the Islamic Heritage Revival Society in Kuwait , and referred to the Committee by the General Secretariat of the Council of Senior Scholars, with number “5171” and date 29/10/1416 AH. The questioner asked questions, and after the Committee studied them, it answered as follows: Q1: Some benefactors approach us requesting a proxy to perform Hajj on behalf of their relatives as a transfer of Hajj, knowing that those for whom the Hajj is being performed are alive and able to perform Hajj. Is that permissible? And is a proxy permissible in Hajj on behalf of a deceased person for a voluntary Hajj, not an obligatory one?
A1 : The proxy in Hajj was only established for the right of a deceased person or a living person who is unable to perform Hajj due to a continuous inability. As for a living person who is able to perform Hajj, there is no evidence for a proxy on his behalf, even if the Hajj is voluntary.
