Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed
what was sent to His Eminence the Grand Mufti from His Excellency: The Director General of the General Administration for Missions Affairs, at the Ministry of Higher Education, with reference number (B / 4 / 12452), dated 24 / 6 / 1420 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with reference number (3378) and dated 26 / 6 / 1420 AH. His Excellency asked a question, the text of which is as follows: We wish to present to the honorable Committee that the Ministry of Higher Education is responsible for supervising disabled students in medical facilities outside the Kingdom, and that this category receives monthly financial allocations, which have multiplied over the years into large amounts exceeding one million Saudi Riyals, where some of it is invested in Islamic banks, thereby increasing its annual returns. Since these funds reach the lunar year (hawl) and zakah on wealth becomes due on them, and since the zakah on the aforementioned wealth cannot be returned to the Ministry, it was deemed appropriate to spend it on children of Saudi fathers residing in those countries whose means have been cut off and who have no financial resources, or to transfer it to charitable associations in the Kingdom to be spent on those who are entitled to it. We hope you will inform us of what the Committee sees in these two opinions, or if there is another opinion that the Permanent Committee sees. Then, contact was made with the questioner for clarification regarding the question, and he provided his letter with reference number (B / 4 / 14213) and dated 16 / 7 / 1420 AH, the text of which is
as follows: In addition to our letter number (12452) dated 24 / 6 / 1420 AH, which included a request for the opinion of the Permanent Committee on the zakah of funds belonging to disabled students residing outside the Kingdom , and since the honorable Committee requested some information from the Ministry’s representative, Dr. Sulayman ibn Abd al-Rahman al-Anqari , the former cultural attaché in the Arab Republic of Egypt , when he met with His Eminence the Grand Mufti of the Kingdom and the honorable members of the Permanent Committee on Tuesday, 10 / 7 / 1420 AH, at the headquarters of the Permanent Committee at the General Presidency for Research and Ifta, it is a pleasure for us to provide the following: 1- The stipend is paid to each disabled student monthly from the Ministry’s budget (pocket money) and is deposited into banks in an account in the name of the cultural attaché. 2- The aforementioned funds, on which the lunar year (hawl) passes annually, belong to individuals with mental disabilities who are unable to manage the stipend paid to them, in addition to the fact that the guardians of many of them do not wish to withdraw these balances, as well as the fact that some other guardians have no contact with the attaché’s office. 3- The cultural attaché, by virtue of his job, is the one who receives the
aforementioned stipends, deposits them in the bank in his name, and spends from them what each disabled person needs in terms of clothing and other items, and the remainder is invested for the benefit of the disabled. We hope that this satisfies the requirement and that the honorable Committee will inform us of what it sees.

After the Committee’s study of the inquiry, it answered that the subject of the question is not free from the following circumstances: The first circumstance: That the disabled person is an adult of sound mind. In this case, he is aware of the amount of zakah obligatory upon him when the lunar year (hawl) is completed, and the official responsible at the attaché’s office deducts it from the disabled person’s account with his permission and pays it on his behalf to those entitled to it, such as the poor and the needy, and others among the categories of zakah recipients. The second circumstance: That the disabled person is below the age of maturity, or is mentally disabled and has a guardian such as a father. In this case, his guardian is aware of the amount of his balance and the amount of zakah obligatory on it when the lunar year (hawl) is completed, and is informed that it will be sent to him to be spent in the channels of zakah, or he delegates the attaché’s office to do so. The third circumstance: That the disabled person is below the age of maturity, or is mentally disabled and does not have a guardian such as a father, or his guardian has abandoned him despite correspondence. In this case, the cultural attaché, who is officially responsible for caring for his affairs, deducts the zakah from the disabled person’s account and spends it on those entitled to it, such as the poor and the needy, and others among the categories of zakah recipients.
