The questioner : They say: We set out from al-Madinah al-Munawwarah to Makkah al-Mukarramah intending to perform 'Umrah, but we passed the miqat because we were ignorant of its location, and the people did not alert us until we were one hundred and fifty kilometers away. However, we did not return; instead, we headed to al-Ja'ranah and entered the state of ihram from there. Is our 'Umrah valid? If not, what must we do?
The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and all his Companions. Our answer to this question is that the 'Umrah is valid because you performed its pillars completely; you performed the ihram, the tawaf, and the sa'y. However, according to the scholars, you owe a fidyah, which is a sheep that you slaughter in Makkah and distribute to the poor. This is because you left off the ihram from the miqat, and entering ihram from the miqat is obligatory. The Prophet (peace and blessings be upon him) designated these miqats and said:Jami` at-Tirmidhi 831Sahih (Darussalam) The word is a statement that carries the meaning of a command, and the default ruling for a command is obligation. Therefore, you have left off an obligatory act. However, since you are excused due to ignorance, the sin is dropped from you. But in place of this obligatory act, which is the fidyah—a sheep that you slaughter and distribute in Makkah—it is necessary according to the scholars. Thus, the 'Umrah is valid, and this blood (sacrifice) is obligatory upon you, as the scholars have stated. Yes.
