Fatwa number ( 12877 )
Q: Allah has blessed me, my father, and my family with the Hajj this year, 1409 AH. During our Hajj, specifically on the day of departure (Nafar), my father and my aunt said to me: We want to buy gifts (clothes). I said to them: Did we come for the Hajj or to buy clothes? They said: Of course, for the Hajj. I said to them: If you want the full reward, you must remember Allah, glorify Him, seek forgiveness, and not waste time on what we will buy and what we will do. My father said:
Let us first perform the Tawaf of Ifadah, and after finishing, we will shop for what we want. I said to them: If you had performed Hajj with me, by Allah, I would not go down to the market. I also said to my aunt: If you go to the market with me, I am like you. My father said: The wives of the Companions used to walk around with their husbands in battles and other things. I replied to them and said: It is not permissible for women to walk around in the markets? This is because women talk to the sellers and raise their head coverings to look at the merchandise. Is this permissible? Knowing that these women had not entered the market except for the first time. Is there an expiation for the oath not to go down and violating it by going down to the market so as not to anger my father and my aunt? Please inform us, may Allah have mercy on you.
A: It is obligatory for you to pay the expiation for an oath because you broke your oath. The expiation is: freeing a believing slave, or feeding ten poor people or clothing them. If you do not find the means to do so, then fast for three days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
