Q: I committed zihar with my wife by saying to her: (You are like my mother to me from today on) and that was the end of it. This occurred on 2/7/1417 AH. When I sought a ruling from some scholars, Shaykh Ahmad Yahya al-Najmi ruled that I must fast two consecutive months, as I am unable to free a slave, but I am physically capable of fasting, being a young man of thirty-three years. He specified that my fasting should begin on 15/7/1417 AH, as the ruling was issued on 14/7. I say: from 15/7, then the month of Sha'ban, then Ramadan, then breaking the fast on the day of Eid, and after that I complete the remainder until 15 Shawwal, while abstaining from marital intercourse and its causes. I actually began fasting on 15/7/1417 AH, and I am physically and healthily capable of fasting up to this day. However, I find that I am unable to restrain myself from my wife for more than that, knowing that I nearly fell into the forbidden act several times, and there are still more than forty-five days remaining.
My question: Is it permissible for me to switch to feeding the poor, or not, given the circumstances described to you?

A: If the situation is as you described, and you fear for yourself falling into the forbidden, then there is no harm in switching to feeding the poor. This means feeding sixty poor people, each poor person receiving half a sa' (a dry measure of about 3 kg) of the staple food of the land, which is one and a half kilograms, before you touch your wife. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
