Q: My father has about five full paternal uncles, and all of them have passed away, as has my father. Some of the uncles left behind children, while others died without leaving any children. The last of the brothers to pass away was a man named Duhman ibn Muhammad, who was my father’s paternal uncle, the brother of
his father. He left behind a daughter named Sharifah bint Duhman ibn Muhammad, and this woman became my father’s paternal cousin, and she has paternal uncles other than my father. The paternal uncles of the aforementioned woman take turns hosting her each year at the home of one of them, who are her paternal uncles, and they attend to her affairs. Since she is approximately 35 years old and has never been married before—knowing that she sometimes loses her senses due to an illness she previously suffered from—and in order to be dutiful to her and out of my desire to marry her in accordance with the way of Allah and His Messenger, I ask your Eminence to issue a ruling: Is it permissible for me, as I am truly the son of her paternal uncle, may Allah reward you?
A: If the matter is as you described, and there is no breastfeeding relationship that would make marriage forbidden between you, then it is permissible for you to marry the aforementioned daughter of your father’s paternal uncle through her closest guardian, provided that her consent is obtained while she is of sound mind. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
