Q: In our village of Wadi 'Amud , there is a man named Salman Ahmad Nasser al-Sulami who was raised in the house of his paternal uncle, Jabir Nasser Wafi, who is his father’s brother. Please note that Salman Ahmad Nasser’s father passed away, and the boy was raised in his uncle’s house from a young age. Allah raised him first, and then his uncle’s wife raised him from childhood until he grew up. Please note that the boy was included in the household of his uncle, his father’s brother, in whose house he was raised. His uncle, Jabir Nasser, had a daughter who was raised in the same house as Salman Ahmad Nasser until they both grew up. Is it permissible for Salman to marry that girl? Please note that he is included in the household of the girl’s father and they were raised in the same house, but the girl’s mother did not breastfeed him (S. A. N.) is included in the household of the girl’s father. Please inform us, may Allah reward you with the best reward.
A: First: Mere upbringing in the same house between the aforementioned boy and his cousin, without breastfeeding between them, does not make marriage forbidden. Therefore, it is permissible for him to marry the aforementioned cousin. Second: It is obligatory for the boy’s uncle to remove his nephew from his household and attribute him to his real father. It is not permissible for the uncle to attribute his nephew to himself. Allah the Exalted said:
Call them by [the names of] their fathers; it is more just in the sight of Allahادْعُوهُمْ لآبَائِهِمْ هُوَ أَقْسَطُ عِنْدَ اللَّهِ
[Al-Ahzab 33:5]
