The third question of Fatwa No. ( 2235 ):
Q3: Allah the Exalted said:[An-Nur 24:2] And He the Exalted said: [An-Nur 24:4] And He the Exalted said: [Al-Ma'idah 5:38] .
These are the ones who commit such major sins, and there is no one to apply the rulings to them, and they die without repenting. What is Allah’s ruling regarding them on the Day of Resurrection?
A3: The belief of the people of the Sunnah and the community is that a Muslim who dies persisting in a major sin, such as unlawful sexual intercourse, falsely accusing someone of zina, or theft, is under the will of Allah, the Exalted. If Allah wills, He forgives him, and if Allah wills, He punishes him for the major sin he died persisting in, and his ultimate destination is Paradise. This is based on the saying of Allah, the Exalted and Glorified:[An-Nisa 4:48] , and the authentic, mass-transmitted hadiths indicating the removal of the sinners among the monotheists from the Fire, and the hadith of 'Ubadah ibn al-Samit (may Allah be pleased with him): - meaning the verse mentioned, and the wording of Sufyan read the verse: Sahih al-Bukhari 4894 .
And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
Q3: Allah the Exalted said:
The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashes
الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍAnd those who accuse chaste women and then do not produce four witnesses - lash them with eighty lashes
وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً[As for] the thief, the male and the female, amputate their hands in recompense for what they committed as a deterrent [punishment] from Allah. And Allah is Exalted in Might and Wise.
وَالسَّارِقُ وَالسَّارِقَةُ فَاقْطَعُوا أَيْدِيَهُمَا جَزَاءً بِمَا كَسَبَا نَكَالا مِنَ اللَّهِ وَاللَّهُ عَزِيزٌ حَكِيمٌThese are the ones who commit such major sins, and there is no one to apply the rulings to them, and they die without repenting. Indeed, Allah does not forgive association with Him, but He forgives what is less than that for whom He wills
إِنَّ اللَّهَ لاَ يَغْفِرُ أَنْ يُشْرَكَ بِهِ وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُWe were with the Prophet (peace and blessings be upon him) and he said: "Will you pledge allegiance to me that you will not associate anything with Allah, not commit unlawful sexual intercourse, and not steal?" And he recited the verse from al-Nisa
كنا عند النبي صلى الله عليه وسلم فقال: أتبايعوني على ألا تشركوا بالله شيئًا ولا تزنوا ولا تسرقوا؟ وقرأ آية النساءWhoever among you fulfills his pledge, will receive his reward from Allah, and whoever commits any of those sins and receives the legal punishment (in this life), his punishment will be an expiation for that sin; and whoever commits any of those sins and Allah screens him, then it is up to Allah to punish or forgive them.
فمن وفى منكم فأجره على الله، ومن أصاب في ذلك شيئًا فعوقب فهو كفارة له، ومن أصاب منها شيئًا من ذلك فستره الله فهو إلى الله إن شاء عذبه وإن شاء غفر لهAnd success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
