The questioner : The listener Al-Awdhi Al-Naji, a Sudanese resident in the Kingdom, asks a set of questions. He says: I work as a shepherd with one of the Bedouin residents, and we have water sufficient for ten days, but it is reserved for drinking, and my employer forbids me from using it for wudu. Is tayammum sufficient in this case? We ask for your guidance. May Allah reward you with good?

The Shaykh : Yes, if there is no water around you that you can use for wudu or for ghusl from janabah, then you may perform tayammum in this situation, based on the saying of Allah the Exalted:
But if you are ill or on a journey or one of you comes from the place of relieving himself or you have contacted women and do not find water, then seek clean earth and wipe over your faces and hands with it وإن كنتم مرضى أو على سفر أو جاء أحد منكم من الغائط أو لامستم النساء فلم تجدوا ماء فتيمموا صعيدا طيبا فامسحوا بوجوهكم وأيديكم منه
[Al-Ma'idah 5:6]
But if you are able to access water, then it is obligatory for you to use it. If it is for wudu, then perform wudu. Yes, if the tayammum is for a minor state of ritual impurity, then perform wudu, and if the tayammum is for a major state of ritual impurity, then perform ghusl. This is because when a person finds water, his tayammum becomes invalid and he is obligated to use it, based on the saying of the Messenger (peace and blessings be upon him):
Pure earth is the wudu of the Muslim, or he said: the purification of the Muslim. And if he does not find water for ten years, then when he finds water, let him fear Allah and let him touch his skin with it. الصعيد الطيب وضوء المسلم أو قال طهور المسلم وإن لم يجد الماء عشر سنين فإذا وجد الماء فليتق الله وليمسه بشرته
And because it is established in Sahih al-Bukhari in the long hadith of Imran ibn Husayn that a man did not pray with the Prophet (peace and blessings be upon him), and the Prophet (peace and blessings be upon him) saw him sitting apart and not having prayed, so he said:
What prevented you? ما منعك
He said: I was afflicted with janabah and there was no water. He said:
Use the earth. عليك بالصعيد
Then water became available, and the Prophet (peace and blessings be upon him) ordered him to perform ghusl. This is evidence that tayammum is invalidated by the presence of water.
