The questioner : He says: A man performed tawaf for 'Umrah and sa'y, then shortened his hair from one side of his head, and then went to his family. What is required of him in both cases: the case where it is difficult for him to return to Makkah, and the case where it is not difficult?

The Shaykh : It is obligatory for him to shave now or shorten his hair, and what he did of the prohibited matters before that is excused because he was ignorant. Shaving and shortening the hair are not required to be done in Makkah; rather, it is permissible in Makkah and elsewhere. So we say to this questioner: Now, take off the clothes you are wearing because you have not yet exited the state of ihram, then shorten your hair with a valid shortening or shave. This is unless, when you first shortened your hair, you believed that this was what was obligatory upon you based on a fatwa you heard, for example. In that case, nothing is required of you, because Allah says:
So ask the people of the message if you do not know. فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَ
[An-Nahl 16:43]
And some scholars hold that shortening the hair from part of the head is like shortening it from the whole head.
