The questioner : It was the time of Ramadan, and on one of the Fridays of that month, while I was sleeping, my wife came and wanted to wake me up, and I actually got out of bed that terrible day. I grabbed my wife and forced her, despite her attempt to say that it was the morning of Ramadan, and I had intercourse with her that day. After that, I felt extreme regret and grieved over what happened. We did not complete the day of fasting; rather, we broke our fast. From that time until now, or from that time to this present time, I have been in a turmoil seeking relief from that, but I have not found anyone to guide me to the expiation for what happened so that I may be reassured and far from punishment. For your information, some advised me to fast two consecutive months, but my body is thin and I cannot fast for that duration. Therefore, I wrote to you about my problem, hoping that the Almighty Lord will guide you to advise me on what is best, and may Allah reward you?

The Shaykh : We hope that what happened from you serves as an expiation for your sins, since you regretted what passed. We hope that you are determined not to return to this forbidden act. However, it is obligatory for you to perform an expiation, which is freeing a slave. This is a difficult matter today. If you do not find one and are not able to obtain one, then you must fast two consecutive months.

The Shaykh : If you are unable to do so, whether in summer or winter, then feed sixty poor people.

The Shaykh : By doing so, you expiate for yourself. As for your wife, if she was forced and could not escape from you, then she owes no expiation and no making up of the fast. She does not make up the fast nor does she perform an expiation because she was forced, unless she broke her fast afterwards, as is apparent from your question.

The Shaykh : That she broke her fast and ate and drank, in which case she must only make up the fast for the sake of her eating and drinking.

The Shaykh : As for if she agreed to this matter and was able to get away but did not try, then she owes the same as you, meaning the expiation of freeing a slave.

The Shaykh : Or fasting two consecutive months, or feeding sixty poor people.

The questioner : How much is given to the poor person?

The Shaykh : The poor people: either you provide them with a breakfast or a dinner.

The Shaykh : The poor people: or you give each one a quarter of a sa' (a dry measure of about 3 kg). The Prophetic sa' is two kilograms and forty grams.
