She says: I married a young man whom we consider committed, and he agreed with my father that he would furnish the marital home, considering the furniture to be the mahr (bridal gift). I came to Riyadh with all my hope for a righteous marital life, but he does not like to sit at home, even after finishing his work. He comes home at a late hour and looks for anything to occupy him outside the house. I advised him many times and was patient with him, but he did not listen to the advice. Two years have passed, and I have a daughter and a son from him now. He has still not saved any money, neither for the house nor for its furnishing, which is my mahr. Whenever I remind him of my rights with him, he does not care. He claims that he spends money on repairing a car of his that is constantly breaking down, and he wastes a lot of his money. Here I ask: Is not the wife's right to a house and mahr more deserving than any other rights, because it is considered a debt upon him?
Second: Is it not the wife's right that he sit with her to comfort her in her foreignness after finishing his work, and remind her of Allah as well? What do you advise me to do, and what should I do, as my mental state has worsened? Do I have the right here to ask for divorce because he is determined and insistent on this life in that form?
Answer: What I advised you before, O noble sister, has already been mentioned, and my advice, as previously stated, is patience and good advice with kind words. Do not despair, do not despair. It is obligatory for him to fulfill the right that is upon him, for paying off a debt is a necessary matter. But Allah Mighty and Majestic says: [al-Baqarah:280]. So if he is in difficulty, be lenient with him and forgive him until Allah makes a way out and an exit. The car today is not hidden from anyone that it is necessary, especially for a working man who goes out on it and returns on it. So he is in great need of it, provided it is a car that suits his like. He must strive to save what is possible of money for the needs of the house and its furnishing. He must fear Allah in being just to you, comforting you, talking to you, and giving you what is possible of his time. This is a necessary matter for him. The Prophet (peace and blessings be upon him) commanded this and said (peace and blessings be upon him): So he must fear Allah and fulfill the duty of his family according to his capacity and ability.
And you should not hasten in asking for divorce. Be patient, be good in your treatment of him, and be glad of the great reward, the much good, and the good outcome. You may be tested with someone worse than him, so do not hasten. The time now is dangerous, and this is the end of time. Evil is more and good is less. So you must be patient and seek reward, and ask Allah for his guidance and success, and that He change his state to a better one. Allah, Glorified and Exalted, is the Doer of what He wills, and He is Able to do everything. And He is the One who said (Glorified and Exalted is He): : [al-Baqarah:155]. And He, Glorified and Exalted, said: [al-Zumar:10]. And His Prophet (peace and blessings be upon him) said: Sahih al-Bukhari 1469. Yes.
